BandTools is operated by John Topley doing business as BandTools (“BandTools”, “we”, “us”, or “our”).

“Service” refers to the BandTools platform, including its website, features, and tools for managing newsletters. “Yours” refers to the content submitted by users, over which they retain ownership. By using BandTools, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our service.

1. Eligibility

You must be at least 18 years old to use BandTools. By using our service, you represent that you meet this requirement.

2. Acceptable Use

You agree to use BandTools only for lawful purposes. You may not use our service to send, share, or store content that:

  • Promotes hate speech, harassment, or discrimination
  • Contains spam, phishing, or fraudulent information
  • Is illegal, infringing, or violates the rights of others
  • Contains adult content, explicit material, or violent imagery
  • Disrupts or harms BandTools, its users, or third parties

We reserve the right to remove any content or suspend/delete accounts that violate these Terms at our sole discretion, without notice or appeal.

3. Account Termination & Refunds

You may cancel your account at any time. If you cancel, your account and all associated data will be permanently deleted immediately. Your username will become available for others to register.

If you are unsatisfied with BandTools, we offer refunds under the following conditions:

  • You request a refund within 30 days of signing up
  • Your account has not been suspended for violating our Terms

Refunds will be processed to your original payment method within a reasonable timeframe.

4. Copyright & Content Ownership

  • All content posted must comply with UK copyright law
  • You grant us a limited licence to use the content posted in order to provide the service to you, but we claim no ownership rights over those materials. All materials you submit to the service remain yours
  • We do not pre-screen content, but we reserve the right (but not the obligation) in our sole discretion to refuse or remove any content that is available via the service
  • We own all right, title, and interest in and to the service, including all intellectual property rights therein, and you obtain no ownership rights in the service as a result of your use. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission. You must request permission to use our service’s logos for any promotional purposes. Please email us requests to use logos. We reserve the right to rescind any permissions if you violate these Terms.
  • You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service, use of the service, or access to the service without express written permission

Refunds will be processed to your original payment method within a reasonable timeframe.

5. Liability Disclaimer

BandTools provides its service “as is” and “as available.” We do not guarantee uninterrupted service, email delivery, or that our service will be free from errors or security breaches. We are not liable for lost data, account suspensions, or damages arising from your use of BandTools.
