“Service” refers to the BandTools platform, including its website, features, and tools for managing newsletters. “Yours” refers to the content submitted by users, over which they retain ownership. By using BandTools, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our service.

1.Eligibility

You must be at least 18 years old to use BandTools. By using our service, you represent that you meet this requirement.

2.Acceptable Use

You are responsible for ensuring that you have lawful grounds to process any email addresses or subscriber data you add to BandTools.

BandTools disclaims all liability for any unlawful subscriber data or email addresses submitted by users. You agree to use BandTools only for lawful purposes. You may not use our service to send, share, or store content that:

  • Promotes hate speech, harassment, or discrimination
  • Contains spam, phishing, or fraudulent information
  • Is illegal, infringing, or violates the rights of others
  • Contains adult content, explicit material, or violent imagery
  • Disrupts or harms BandTools, its users, or third parties

You must also comply with all applicable anti-spam and electronic marketing legislation, including:

  • UK Privacy and Electronic Communications Regulations (PECR) 2003 — you must have consent to send marketing emails to subscribers
  • CAN-SPAM Act 2003 (US) — all newsletters must contain a functioning unsubscribe mechanism and accurate sender information
  • Canada’s Anti-Spam Legislation (CASL) — you must have express consent from Canadian recipients before sending commercial electronic messages

BandTools provides a double opt-in subscription flow and one-click unsubscribe to help you meet these requirements. It is your responsibility to ensure that all subscribers have given valid consent.

Automatic Newsletters

If you use the automatic newsletters feature to create newsletters from external RSS or Atom feeds, you are solely responsible for ensuring that you have the right to use and redistribute the content obtained from those feeds. BandTools fetches feed content solely on your instructions and does not verify or claim any rights over that content. You must ensure that your use of feed content complies with the original publisher’s terms of use, applicable copyright law, and any relevant licence conditions.

API access

If you generate API tokens and share them with third-party applications (including tools you build yourself) to access your BandTools data, you are solely responsible for safeguarding those tokens and for the conduct of the applications that use them. You must not share tokens with services that will use them in violation of these Terms or applicable law. Actions taken using your API tokens are treated as your actions for the purposes of these Terms. You should delete tokens immediately from the Settings → API tab if you believe they may have been compromised.

Newsletter Collaboration

If you use the newsletter collaboration feature to share a draft newsletter with another person for editing, you are solely responsible for ensuring that you have a lawful basis to share their email address with BandTools and to send them an invitation. BandTools sends collaboration invitation emails solely on your instructions.

Anyone who accepts a collaboration invitation must hold a BandTools account and is therefore subject to these Terms in their own right. Actions taken by collaborators on a shared draft (including any edits or preview emails sent to themselves) are treated as their own actions for the purposes of these Terms. As the newsletter owner, you alone retain the ability to send the newsletter to subscribers or schedule it for sending; collaborators cannot do either. You remain responsible for the final newsletter that is sent to your subscribers, regardless of which collaborators contributed to the draft.

Webhooks

If you configure webhooks to transmit event data (including subscriber email addresses) to external services, you are responsible for ensuring that the receiving endpoints comply with all applicable data protection laws. BandTools transmits data to webhook endpoints solely on your instructions and is not responsible for how third-party services process the data they receive.

We reserve the right to remove any content or suspend/delete accounts that violate these Terms at our sole discretion, without prior notice.

3.AI Moderation Transparency

BandTools uses automated content moderation tools, including AI services such as those provided by third parties, to help identify content that may violate these Terms. The purpose of these systems is to help detect potentially unsafe or prohibited content so that it can be reviewed by a human moderator.

These automated tools do not make final decisions about compliance, and final enforcement decisions (such as blocking, holding, or removing content) are made by BandTools personnel. You agree that content you submit may be analysed by automated tools as part of this moderation process.

4.Account Termination & Refunds

You may cancel your account at any time. If you cancel, your account and all associated data will be permanently deleted immediately. Encrypted database backups containing your data may persist for up to 30 days before being overwritten in the normal backup rotation cycle. Your username will become available for others to register.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a statutory right to cancel a digital service purchased at a distance within 14 days of purchase for a full refund. We go further: if you are unsatisfied with BandTools, we offer a full refund under the following conditions:

  • You request a refund within 30 days of signing up
  • Your account has not been suspended for violating our Terms

Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Lemon Squeezy handles all payment-related customer service inquiries and refunds.

Refunds will be returned to your original payment method and may take up to 10 business days to appear on your statement.

Outside the 30-day refund window, no partial or pro-rata refunds are offered for unused time on a monthly or annual subscription. If you cancel your subscription, you retain access to your paid plan until the end of the current billing period.

5.Service Communications

By creating a BandTools account, you agree to receive operational service communications from us by email. These include notices about platform maintenance, security alerts, policy changes, and other matters relating to the operation of the service.

Service communications are necessary for the provision of the service and cannot be opted out of while you have an active account. They are not marketing emails and do not include promotional content. The only way to stop receiving service communications is to delete your account.

7.Liability Disclaimer

BandTools provides its service “as is” and “as available.” We do not guarantee uninterrupted service, email delivery, or that our service will be free from errors or security breaches. We are not liable for lost data, account suspensions, or damages arising from your use of BandTools.

8.Updates to These Terms

We may update these Terms at any time. The latest version will be posted on this page with the “Last Updated” date updated accordingly. Your continued use of BandTools constitutes acceptance of any changes.

9.Governing Law

These Terms are governed by the laws of England & Wales. Any disputes will be resolved exclusively in the courts of England & Wales.

10.Privacy Policy

By using BandTools, you also agree to the terms of our Privacy Policy, which explains how we collect, use, and share your data, including the use of AI‑assisted content moderation. The Privacy Policy is incorporated into these Terms by reference and can be found at: Privacy Policy.

If you use BandTools to manage newsletter subscribers, the Data Processing Agreement also forms part of these Terms.
